3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The University of Leeds, School of Civil Engineering requires construction of a custom-built environmental test chamber for bioaerosol research activities. The research activities carried out within the chamber will include deliberate aerosolisation of biological agents of up to Hazard Group 2 (ref. Approved List of Biological Agents produced by the Advisory Committee on Dangerous Pathogens (ACDP) on behalf of the HSE). In order to permit fumigation the chamber will be designed to comply with the requirements for Containment Level 3 (CL3) as specified in HSE publication ‘Management and operation of microbiological containment laboratories 2018’. Because of the unique specification of the chamber and the complexity of the project, the University intends to enter into a contract with Sanber Limited who have recognised experience in the field.
