3. Explanation

   Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
   lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
   We do not believe that it is possible to offer this contract for competitive process because it relies on utilising an existing hardware fleet that has been leased under a previously tendered contract. These devices are now out of their originally agreed lifespan but, due to under use, are still in excellent working order. Other vendors would not have access to our existing devices and would not, therefore, be make a competitive offer.
