3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
This is a short term award pending an evaluation of the product set and the associated business case. We believe that there is a compelling case for a direct award to Billigence for two key reasons. Firstly their knowledge of our current architecture makes it unrealistic for another provider to come in and provide the services at this stage. We believe that any such tender would incur unrealistic internal resource costs and would not result in a fair tender. Secondly, the short term nature of the award makes it unappealing to the market at this point, bearing in mind the resource requirements required of them with no commitment to any term beyond a single year.
